Emigration check not required (ECNR) stamp is not required, if one is not travelling for employment purposes.
The Ministry of Overseas Indian Affairs (Emigration Policy Division) have allowed ECR passport holders travelling abroad for purposes others than employment to leave the country on production of valid passport, valid visa and return ticket at the immigration counters at international airports in India w.e.f. 1st October 2007.
ECNR is only required if you are travelling to any of the below 17 countries for employment:
United Arab Emirates (UAE), The Kingdom of Saudi Arabia (KSA), Qatar, Oman, Kuwait, Bahrain, Malaysia, Libya, Jordan, Yemen, Sudan, Afghanistan, Indonesia, Syria, Lebanon, Thailand and Iraq.
For all passports issued before January 2007, a blank second page in the passport means your passport is endorsed with ECR and you need to get emigration clearance if you are travelling to any of the above 18 countries for employment.
For all passports issued after January 2007, a “Blank” page 2 on your passport is deemed to have been ECNR endorsed. If you don’t fit into ECNR eligibility criteria, and Emigration Check is Required, there will be an endorsement in the passport regarding ECR.
Eligibility for ECNR status:
The following applicants are eligible for Emigration Check Not Required (ECNR) status:
- Gazetted Government servants, their spouses and dependent children
- Holders of Diplomatic/official Passports
- Persons having educational qualifications of matriculation and above
- Persons above the age of 50 years
- Children up to the age of 18 years. (For re-issue of passport, after they attain the age of 18 years, documents to proof their non-ECR category has to be submitted, else ECR stamping will be done)
- Income-Tax payers (including Agricultural Income-Tax payees) in their individual capacity, their spouses and dependent children below the age 18 years.
- Persons possessing two years diploma from any institute recognized by the National Council for Vocational Training (NCVT) or State Council of Vocational Training (SCVT), or persons holding three years diploma/equivalent degree from institutions, such as Polytechnics recognized by the Central/State Governments of India
- Nurses possessing qualifications recognized under the Indian Nursing Council Act. 1947
- All professional Degree holders , their spouses and dependent children. Examples of professional degree holders are Doctors holding MBBS degree or equivalent degree in AYURVED or HOMEOPATHY, accredited Journalists, Engineers, Chartered Accountants, Cost Accountants, Lecturers, Teachers, Scientists, Advocates, etc
- All persons who have been staying abroad for more than three years (the period of three years could be either in one stretch or broken) and their spouses
- Seamen who are in possession of Continuous Discharge Certificate (CDC), or Sea Cadets and Deck Cadets
a. who have passed the final examination of three years B.Sc. Nautical Sciences courses at T.S. Chanakya, Mumbai and b. who have undergone three months pre-sea training at any of the Government approved training institutes, such as T.S. Chanakya, T.S. Rehman, T.S. Jawahar, MTI (SCI) and NIPM, CHENNAI, after production of identity cards issued by the Shipping Master at Mumbai/Kolkata/Chennai - Persons holding Permanent Immigration Visa, such as the visas of UK, USA and Australia.
How to apply for ECNR stamping
If and only if you are travelling to any of the below countries for employment, you need to get ECNR stamp, if you does not have already:
United Arab Emirates (UAE), The Kingdom of Saudi Arabia (KSA), Qatar, Oman, Kuwait, Bahrain, Malaysia, Libya, Jordan, Yemen, Sudan, Afghanistan, Indonesia, Syria, Lebanon, Thailand and Iraq.
You have either to get the entire ECR stamp deleted, or if your are not eligible (categories listed above), you may get a temporary Emigration Suspension before leaving India. If the applicant does not have Non-ECR status then All such ECR passport holders need to obtain Emigration Clearance Certificate from the Protector-General of Emigrants, Ministry of Overseas India Affairs.

My question is very different,but it seems you will be able to help. I got an offer to work in an oil company based in Sharjah, U.A.E . Now the company is saying that your work visa is being denied by UAE authorities only on a ground that your passport is made from Lucknow. I am really surprised as i cannot understand this crieteria ( Passport from Lucknow ) of rejecting my Visa. Just wanna know can this be a crieteria for denying me work visa.

First, if their passport does not have ECR stamp, their passport is already with ECNR status.
Second, they would need ECNR status if they are not going to UAE for job.
Do I need a ECNR Stamp specifically for working in Dubai? My Employer is asking for one. I am a Graduate and my New Passport doesn’t have the ECNR stamp (which I understand means it is ECNR). Nevertheless, They have requested me to procure the ECNR Stamp to process my visa? Do I have to go to the PSK which issued my passport or the POE office?

Your employer may be living in old world. Now-a-days no ECNR stamp is affixed on passports. No ECR stamp means ECNR status on new passports.
People who have ECR status can get emigration clearance from PoE office.

For visiting US on any kind of visa, ECNR is not needed. One may fly even with ECR status.

I have a new passport that is in the process of being issued. While i went for my appointment i did not have my school leaving certificates with me. So i believe they will b creating a passport with ECR status.
I go to Dubai at least 4-5 times a year to meet family for a day or 2 sometimes for an event performance. (i work in events) – Will they stop me at the indian or dubai airport? What is the best way to go about things….? Is it possible to get a ECNR per trip basis? And how long does it take to get that?
right now i have some travel coming up in march 1st week so any advice will be much appreciated.

In case you asked for ECNR status and provided any of the proof mentioned on this page: http://www.passportindia.gov.in/AppOnlineProject/onlineHtml/NonEcrDocuments.html, you should be getting ECNR passport.
Also, if you are not going to Dubai for job, you won’t need ECNR status. Only return tickets and valid visit/travel visa would be sufficient.
Temporary ECNR stamp can be obtained on per trip basis and it may take 1-3 days.

Sorry if I am posting my question in wrong category.
My mother already has a savings account in SBI. She recently transferred her Pension account from another state. Her total source of income is less than 1 lakh INR. In this case –
1. Is it mandatory to have PAN card to get the pension under recent Income Tax rules? Earlier she had submitted form 60 or may be 15 c as an alternative for Pan card in banks. The bank is telling that Pan card is mandatory.
2. The bank official said that they cannot give the pension amount (arrears transferred from another bank) during financial year end i.e in March.
Is there any rule for this?

We don’t have any idea PAN card requirement for getting pension and about year end amount transfer.
In case of fixed deposits, Bank need PAN to avoid deducting TDS at 20% rate.

I am working in Bahrain for last 1 year. I don’t have ECNR on my passport and I am 10th Class failed. So I am not eligible for getting ECNR. I didn’t faced any problem because of ECR when I came to Bahrain first time on a visit visa and later converted into work visa. Now the work visa is stamped on my passport. So my query is does it cause any problem when I am returning from India to Bahrain after vacation because of ECR. I heard ECR will cause problems only when you travel on a new visa. Is it correct or not? Please Clarify
Also please note, I don’t have any embassy attested contract letter. So getting temporary ECR suspension is out of option.

As now you have a employment visa on your passport, emigration officer may stop you at airport if you don’t have ECNR status or emigration clearance.
I would advise you to get emigration clearance from PoE office before leaving India.
Hello Pankaj. I have seen you are helping with your advice regarding ECNR.
I have employment visa for UAE and my passport has ECR stamp. my employer is saying there is no need of ECNR stamping and I can enter UAE and will get resident visa after reaching. According to them ECNR is required for lower lever workers like driver, maids etc and as I am an Engineer degree holder so NO need of ECNR status in my case. Please advice and thanks for your help in advance.

ECNR status is required if you are going out of India on employment visa to any of the listed countries.
UAE comes in this list of countries. You may be sent back by emigration officer from Airport. So I would advise you not to take a risk and get ECNR status by applying for reissue of passport.
Or if you don’t have much time, atleast get emigration clearance from PoE office. You can apply online on: http://www.poeonline.gov.in/
