Emigration clearance not required (ECNR)

Emigration check not required (ECNR) stamp is not required, if one is not travelling for employment purposes.

The Ministry of Overseas Indian Affairs (Emigration Policy Division) have allowed  ECR passport holders travelling abroad for purposes others than employment  to leave the country on production of valid passport, valid visa and return ticket at the immigration counters at international airports in India w.e.f. 1st October 2007.

ECNR is only required if you are travelling to any of the below 17 countries for employment:
United Arab Emirates (UAE), The Kingdom of Saudi Arabia (KSA), Qatar, Oman, Kuwait, Bahrain, Malaysia, Libya, Jordan, Yemen, Sudan, Afghanistan, Indonesia, Syria, Lebanon, Thailand and Iraq.

For all passports issued before January 2007, a blank second page in the passport means your passport is endorsed with ECR and you need to get emigration clearance if you are travelling to any of the above 18 countries for employment.

For all passports issued after January 2007, a “Blank” page 2 on your passport is deemed to have been ECNR endorsed. If you don’t fit into ECNR eligibility criteria, and Emigration Check is Required, there will be an endorsement in the passport regarding ECR.

Eligibility for ECNR status:

The following applicants are eligible for Emigration Check Not Required (ECNR) status:

  1. Gazetted Government servants, their spouses and dependent children
  2. Holders of Diplomatic/official Passports
  3. Persons having educational qualifications of matriculation and above
  4. Persons above the age of 50 years
  5. Children up to the age of 18 years. (For re-issue of passport, after they attain the age of 18 years, documents to proof their non-ECR category has to be submitted, else ECR stamping will be done)
  6. Income-Tax payers (including Agricultural Income-Tax payees) in their individual capacity, their spouses and dependent children below the age 18 years.
  7. Persons possessing two years diploma from any institute recognized by the National Council for Vocational Training (NCVT) or State Council of Vocational Training (SCVT), or persons holding three years diploma/equivalent degree from institutions, such as Polytechnics recognized by the Central/State Governments of India
  8. Nurses possessing qualifications recognized under the Indian Nursing Council Act. 1947
  9. All professional Degree holders , their spouses and dependent children. Examples of professional degree holders are Doctors holding MBBS degree or equivalent degree in AYURVED or HOMEOPATHY, accredited Journalists, Engineers, Chartered Accountants, Cost Accountants, Lecturers, Teachers, Scientists, Advocates, etc
  10. All persons who have been staying abroad for more than three years (the period of three years could be either in one stretch or broken) and their spouses
  11. Seamen who are in possession of Continuous Discharge Certificate (CDC), or Sea Cadets and Deck Cadets
    a. who have passed the final examination of three years B.Sc. Nautical Sciences courses at T.S. Chanakya, Mumbai and b. who have undergone three months pre-sea training at any of the Government approved training institutes, such as T.S. Chanakya, T.S. Rehman, T.S. Jawahar, MTI (SCI) and NIPM, CHENNAI, after production of identity cards issued by the Shipping Master at Mumbai/Kolkata/Chennai
  12. Persons holding Permanent Immigration Visa, such as the visas of UK, USA and Australia. 

How to apply for ECNR stamping

If and only if you are travelling to any of the below countries for employment, you need to get ECNR stamp, if you does not have already:

United Arab Emirates (UAE), The Kingdom of Saudi Arabia (KSA), Qatar, Oman, Kuwait, Bahrain, Malaysia, Libya, Jordan, Yemen, Sudan, Afghanistan, Indonesia, Syria, Lebanon, Thailand and Iraq.

You have either to get the entire ECR stamp deleted, or if your are not eligible (categories listed above),  you may get a temporary Emigration Suspension before leaving India. If the applicant does not have Non-ECR status then All such ECR passport holders need to obtain Emigration Clearance Certificate from the Protector-General of Emigrants, Ministry of Overseas India Affairs.

  1. ‘what is the validity of a POE Stamp? the stamp does not mention any expiry date.

    i have ECR in my passport and got a POE stamp for my job in Abu Dhabi in june 2014 and have travelled from Hyderbad to UAE.

    Can i make a short trip using the same stamp as long as i am with same employer?
    many semi skilled workers in my company with ECR have made multiple trips using single initial POE stamp..

    Please let me know

  2. Hello sir.. I need a small clarification that . My husband employment visa is on old passport which is ecr stamped.. but he is graduate. .he had applied for new passport for ecnr he got it.. the problem is some agents are telling that even if u carry both the passports with u .sometimes the emigration officer may stop u from boarding… it may depend on his mood. What is this sir.. if my husband is having genuine certificates also ..he vil b stopped .?

  3. I have following doubts while applying my Wife’s passport:
    (1) Being a Husband I have indicated my name in “Spouse’s Given Name” filled, Now further can I indicate my name in “Emergency Contact” & “First Reference” filled also?
    (2) Can we use typical “Ben” & “Bhai” extension after applicant name in application (I do not have any proof other than my wife’s LC without this “ben” in her name)

      1. Yes you can give your name in emergency contact, but I would recommend another name (neighbour would be better) in reference field.
      2. It should be avoided, but in case you don’t have proof without it, it can only be used.

    Q-1 : I have applied for my child’s passport. As suggested by you, I am going to attach Annexure-H duly signed by me & my wife.
    Now my doubt is ; I am having my passport issued to me. My wife doesn’t have passport. In this case any other documents required to be submitted alongwith my Child’s passport application???

    Q-2 : My brother also applied for passport. However, He doesn’t have his Marriage Certificate issued as on date. What else he can submit alongwith his passport application????

    Q-3 : Now for My Wife’s Passport, She doesn’t have his Birth Certificate. She is having her School Leaving Certificate Xerox copy (original lost). What is to be done now?? She doesn’t have any other doc. proof otherthan Marriage Certificate & my Ration Card (with her name added after marriage)

    Passport Appointment already taken for all on same day 18th.

      1. Your passport copy would act as address proof for child and mother need not to have passport. Annexure H would be sufficient.
      2. Your brother can get Annex D (http://passportindia.gov.in/AppOnlineProject/pdf/AnnexureD.pdf) instead of marriage certificate.
      3. If your wife is born before 26/01/1989, she can submit: School leaving certificate / Secondary School leaving certificate/ Certificate of Recognized Boards from the school last attended by the applicant or any other recognized educational institution.

        Regarding my Q-2 for Not availibility of Marriage Certificate I have following queries:
        Q-1 : My brother’s marriage year is Apr-2012. In this case also this Annexure-D will work or not???
        Q-2 : Passport Annexure-D is having heading “ANNEXURE ‘D’
        SPECIMEN AFFIDAVIT TO BE SUBMITTED ALONG WITH APPLICATION FOR PASSPORT BY A WOMAN APPLICANT FOR CHANGE OF NAME AFTER MARRIAGE (JOINT AFFIDAVIT TO BE SUBMITTED ALONG WITH HER HUSBAND)”
        I understand this is to be submitted by Female applicant for change of her name after marriage.
        Whether is will work for Male Applicant also????

        Q-3 : Should I Rename heading/Mention Annexure-D heading as

        “ANNEXURE ‘D’

        JOINT AFFIDAVIT

        SPECIMEN AFFIDAVIT TO BE SUBMITTED ALONG WITH APPLICATION FOR PASSPORT”

        Q-4 : Following Notes mentioned in Passport Annexure-D should be kept while printing the affidavit (Annexure-D) on stamp paper of 100 Rs.

        “Note:
        1. This affidavit may be sworn before a Judicial Magistrate or Executive Magistrate/Notary Public.
        2. The joint photograph of the couple is to be pasted on the bottom left hand side of the affidavit paper and attested by the Judicial Magistrate or Executive Magistrate/Notary Public with his/her signature and rubber stamps (half on the photograph and half on the affidavit).
        3. Declaration 2 above to be ignored by applicants who seek endorsement of name of spouse in respect of reissue of a previously issued passport.
        4. If a joint photograph cannot be affixed, then affidavit should indicate the reason why it cannot be affixed.”

          1. Yes, annexue would work for recent marriages too.
          2. Ya, It would work for both. I got my passport reissued last year with it without marriage certificate.
          3. There is no need to change heading, its just a specimen. You need to get it made by Notary Public. He would it himself.

    In my passport the details if mine in main page is writtened by handwriting pen (not printed).
    now my friend is telling that you have to get new passport.
    but I travelled Malaysia for 4 times with the same passport. now I planned to move for UAe .
    pls tell whether I have to get new passport? or is these enough

    I visited dubai in last month on visit visa there i started my shop but after the procedure for shop agreement and other govt formalities i came to india for employment visa here i came to know that there is ECR stamp on my paspport and m no able to go dubai on partner visa i am 12th pass .

    and i have also not a passport while i applied for passport for myself also.
    In this case any other documents required to be submitted alongwith my Child’s passport application???

  12. Sir I have ecr stamp in my passport and i got employment visa for dubai but now i want to reissue my passport for ECNR Status but i dont have 10th certificate original. Its will be come in after one month approx and then my visa will be expire! So now i have internet webpage result copy of my 10th class pass, so can i get ecnr status?? If i submitt my internet webpage pass result and exam orignal identy card also?
